Flink ADR Cancellation
Policy and Review.

We understand that circumstances can change and that a scheduled arbitration or mediation may occasionally need to be cancelled or rescheduled.

Flink ADR's cancellation process is designed to provide a fair and reasonable review of each cancellation rather than impose an automatic cancellation fee.

Cancellations requested less than 10 days prior to the booked session date may result in a cancellation fee; Please read the following then return to the booking page and acknowledge same:

We Review all Cancellations Individually

If a scheduled and reserved date for your case is cancelled less than 10 days prior to the scheduled date, the cancelling party may be asked to provide a brief explanation of the circumstances leading to the cancellation, and communicated directly to the assigned neutral.

The neutral will then respond to the cancelling party and, when appropriate, may seek information from the other party or parties involved in the proceeding.

The selected neutral will then determine, in their discretion, whether a cancellation fee is appropriate.

The Why Behind Cancellations Fees

The timing of a cancellation is an important consideration because a neutral reserves the scheduled date and time specifically for the proceeding.

When a proceeding is cancelled less than 10 days before the scheduled session, the neutral may have little or no opportunity to rebook that date.

For example, a neutral may reserve a date several months in advance for a scheduled mediation or arbitration. During the period leading up to that date, the neutral may receive other requests for the same date but must decline them because the date has already been reserved.

If the original proceeding is subsequently cancelled shortly before the scheduled session, the neutral may no longer have a reasonable opportunity to fill that opening.

The potential loss of that reserved professional time may therefore be considered by the neutral when determining whether a cancellation fee is appropriate.

We DO NOT Automatically Charge a Cancellation Fee

Each cancellation will be considered based on the circumstances surrounding the cancellation, including:

  • The timing of the cancellation;

  • The reason for the cancellation;

  • Whether the circumstances were reasonably foreseeable;

  • Any other circumstances the neutral believes are relevant.

The neutral has discretion to determine whether a cancellation fee is appropriate and, if so, the amount of the fee. Fees may range in terms of amount, but they will not be more than 4 hours at the hourly fee of your selected neutral.

Our Goal

Our goal is to handle cancellations fairly and reasonably while recognizing that a neutral's reserved date represents a commitment of that professional's time and availability.

We encourage all parties to communicate cancellations as soon as possible. Early notice provides the greatest opportunity for the neutral to make the reserved date available for another matter.
